Personal and Non-Personal Information
When visiting the AutoVantage web site and other Trilegiant related sites, in order to join, make a purchase, register to use certain services, enter a contest, respond to a survey or update your information you may be asked to provide certain personally identifiable information ("Personal Information") about yourself, such as your name, e-mail address, physical address, telephone number, date of birth, mother's maiden name or social security number. For purchases, we require a name, physical address, telephone number, and credit card number. You may review and revise any Personal Information we have about you by sending a request to service@autovantage.com or calling 1-877-259-2696.

We may also request non-personally identifiable information ("Aggregate Information"), such as annual income, buying preferences, or your age. Providing this demographic and profile type of information is optional. This information is collected anonymously, so we have information about everyone as a group who answered the questions, rather than Personal Information about a single individual's responses.

Information Usage
We use Personal Information to fulfill orders and to contact a purchaser when necessary, such as when a delivery may be delayed or when an ordered product is out of stock. We may also use this information to notify consumers about new products or services and special promotions offered by AutoVantage or any of its affiliates. We may share Personal Information relating to your transactions or experience with us, with our affiliates, such as the other membership services operated by Trilegiant Corporation and its affiliates (including those existing currently or in the future). From time to time, unless we are restricted by applicable contract, we may also share your Personal Information with trustworthy unaffiliated third parties, who offer products or services that we feel may be of interest to you.

Beginning October 1, 2008, we will not share any personal information with our affliates for purposes of marketing their products and services unless we are otherwise permitted to do so by law.

We may use Aggregate Information to improve and enhance your experience on the AutoVantage web site. For example, we may use certain preferences you provide to tailor your experience at our site, such as showing you content and sending you notices concerning merchandise and services that may interest you. We may also share this Aggregate Information with other unaffiliated third parties, such as advertisers interested in advertising on the AutoVantage web site, in an aggregate, anonymous form, which means that the shared information will not contain nor be linked to any personally identifiable information about you or any other person.

Internet Protocol (IP) Address
We may use your IP address to help diagnose problems with our server and to administer our Web site. Your IP address will never be linked to any of your Personal Information unless you are in the process of making a purchase, in which case the link between this information will terminate upon your final purchase.

Clickstream
As you use the Internet, a trail of electronic information is left at each web site you visit. Your Acceptance of this Policy
By using this site, you signify your assent to our Privacy Policy. If you do not agree with the terms of this policy, please do not use our AutoVantage site. This Privacy Policy supersedes all privacy policies and other similar standards previously issued by us. Since the privacy standards set forth herein are subject to updates and other changes and other changes from time to time, please note that this Privacy Policy is subject to change at any time. In the event of any such changes, we will notify all of our members and other customers of such changes in the manner and to the extent required by law. Your continued use of our site following the posting of changes to these terms means you accept these changes.

 

AGREEMENT made between Trilegiant Corporation, a Delaware corporation, with offices at 6 High Ridge Park, Stamford, CT 06905, providing a service called AutoVantage / AutoVantage Gold (herein collectively called "ATV", except where noted), and the person whose membership number and access code was entered to access AutoVantage or the person accessing and utilizing the non membership fee components of AutoVantage ("AutoVantage.com").

WITNESSETH:
1. SERVICE

(a) The service which ATV shall provide to you during the term of your membership shall include the following auto-related services: (i) New and Used car summaries, automobile pricing and dealer referral service; (ii) Discounts on parts and labor at participating service centers and new car dealers (iii) Emergency Roadside Assistance and Tow service (Emergency Roadside Assistance, Towing, and Lockout services are available to AutoVantage Gold members only); (iv) Trip Routing service (available to AutoVantage Gold members only); (v) Travel Discounts and other benefits that may be hereafter included. The service which AutoVantage.com shall provide to you if you are not a paid member shall include the then current components of AutoVantage.com available for non-member use: (i) new and used car summary information; (ii) new and used car buying services.(b) It is understood and agreed by the parties that ATV is an auto information service. Our network of licensed auto dealers and repair facilities is available to sell cars and to provide new car prices and auto maintenance services to members. (c) ATV reserves the right to change or modify the terms and conditions of this Agreement at any time without notice. ATV may cancel this Agreement upon written notice and refund the current term's membership fee.

2. WHO MAY USE
You agree that you will use ATV only for your own behalf and for the members of your immediate family residing in your household. You will be responsible for all use of your membership number and must notify ATV immediately of any unauthorized use of your membership number or theft or misplacement of the membership number.

3. LIABILITY
ATV and its parent, subsidiaries, and affiliates shall have no liability to you as a seller of any products or vendor services, including without limitation, any liability for any defective product. ATV MAKES NO WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO ANY PRODUCTS OR SERVICES SOLD OR INFORMATION DELIVERED OR PROVIDED TO YOU, INCLUDING WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ATV SHALL UNDER NO CIRCUMSTANCES, BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. ATV'S LIABILITY TO YOU SHALL IN NO EVENT EXCEED THE AMOUNT OF THE ATV MEMBERSHIP FEE. ATV shall have no liability for any delay in delivery for any cause beyond ATV's control, including delay due to union disputes or factory production schedules. ATV shall not be responsible for any errors or omissions including information in the Auto Summaries, price changes, or out of stock vehicles. Information on car makes, models, maintenance discounts, access telephone numbers and procedures is subject to change without notice. ATV shall have no liability in regard to any travel services provided, or to be provided, by any Vendor. You agree that any claim with regard to travel services shall be made against the Vendor of such services and not ATV. ATV's sole obligation hereunder shall be to forward to the Vendor all payments for services ordered, and to forward to you all necessary travel documents. ATV and its parent, subsidiaries, and affiliates assume no responsibility nor liability in connection with the service of any train, vessel, carriage, aircraft, motor vehicle, or other conveyance which may be used, either wholly or in part, in connection with the services ordered, nor will any of them be responsible for any act, error, or omission, or for any injury, loss, accident, delay, or irregularity which may be occasioned by reason of any defect in any vehicle, or through the neglect of any person engaged in carrying out the purpose for which tickets or coupons are issued including, but not limited to, tour guides, vehicle operators, and hotel administration and staff. ATV shall have no liability in the event any itinerary or arrangements are altered by Vendor. Any travel information provided by ATV to you is subject to change without notice. All services ordered are subject to the availability of such services from the Vendor.

4. GOVERNING LAW; ARBITRATION
This Agreement, and the respective rights and obligations of the parties hereunder, shall be governed by, and construed in accordance with, the laws of the State of Connecticut. If there is a dispute between you and Trilegiant, either of us may elect to have it resolved by proceeding in small claims court or by final and binding arbitration administered by the National Arbitration Forum, or the American Arbitration Association, under their rules for consumer arbitrations. All disputes in arbitration will be handled just between the named parties, and not on any representative or class basis. YOU ACKNOWLEDGE THAT THIS MEANS THAT YOU MAY NOT HAVE ACCESS TO A COURT OR JURY. The terms of this Section shall survive any termination, cancellation or expiration of this Agreement.

5. MEMBERSHIP FEE
The current term's membership fee for AutoVantage will be billed to your designated credit, debit card (or to the related checking account) on the terms described in your membership materials.

6. RIGHT TO CANCEL MEMBERSHIP
You have the right to terminate this Agreement at any time. You may cancel this Agreement by calling 1-877-259-2696, writing to AutoVantage, P.O. Box 41219, Nashville, TN 37204, Attention: Membership Department, emailing service@autovantage.com, or clicking the cancel link on the Customer Center page at www.autovantage.com. If you cancel during your trial period, you will will not owe any monthly membership fee. If you cancel this Agreement at any time after your trial period, you will not be billed for any additional months. You will remain liable for any other fees or charges to be paid pursuant to this Agreement.

7. RENEWALS
Unless you notify ATV that you do not wish to renew your membership, AutoVantage will automatically renew your membership at the end of each term and bill the renewal fee to the same card or credit line your original membership fee was billed to, or the current card we have on our files. Please see number 6 for address and phone number. You will be notified of any price increase and may cancel your membership if you do not want to continue to be billed at the new price.

8. CONFIDENTIALITY
All information and software provided through AutoVantage is and shall remain the sole and exclusive property of AutoVantage. You shall not publish, broadcast, retransmit, or otherwise reproduce, the information or software in any medium. Any violation of this restriction is an infringement of copyright or proprietary rights in the information and software.

9. CAR BUYING AND PRICING
All prices provided on this site are estimates only and provided by independent sources over which AutoVantage has no control. All prices provided on this site by CarperksTM network of independent dealers are in U.S. dollars, based upon the U.S. configuration for the applicable vehicle, and exclude tax, title, license, registration and destination charges, locally required equipment, options and regional marketing and advertising costs unless otherwise specified. Prices, features and options are subject to change at any time without notice. AutoVantage is not responsible for, and makes no warranties or guarantees relating to the accuracy of any vehicle price, features, recommendations, or any other information provided herein by any dealer or other source including, but not limited to, the new car summaries provided by New Car Test Drive ©. Picture(s) are for reference purposes only and may not accurately reflect all aspects of the vehicle described, which will vary depending on the trim level, features and options chosen. Actual features, options, and colors may vary depending on manufacturer and dealer availability.

AutoVantage Security Guarantee

Your credit or debit card is safe at AutoVantage. Our site uses the latest in encryption technology, digital certificates, secure commerce servers and authentication to ensure that your personal information is secure online. We are so confident that our encryption technology will protect the security of your online transactions that we offer AutoVantage members the AutoVantage Security Guarantee.

If your card number is stolen online while using AutoVantage and fraudulent charges are made to that card, AutoVantage will reimburse you for the amount of fraudulent charges not covered by your credit or debit card issuer. With a guarantee like ours, you can feel free to take full advantage of everything that AutoVantage has to offer -- purchasing auto-related goods and services at great prices.

IMPORTANT NOTICE: YOUR LIABILITY FOR FRAUDULENT CHARGES UNDER FEDERAL LAW: For credit cards: if the card issuer has notified you of your maximum potential liability, has provided a means for you to notify the card issuer of credit card loss, and if the credit card contains a way of identifying the authorized user, then your liability for fraudulent charges made to your card before the card issuer is notified is up to $50.00 on each card. For debit and cash machine cards: your liability for fraudulent use of your cards is up to $50.00 if you notify the card issuer of card loss within two days. After that, your liability is up to $500.00. Or, if you do not notify the card issuer within 60 days of receipt of a monthly statement showing unauthorized charges, then your liability is up to $50.00 and the total amount of unauthorized charges that occurred after the 60-day period and before notice, provided that the card issuer establishes that the unauthorized charges would not have occurred if you had notified the card issuer within that time. (MA bank cards, $50.00 maximum liability per card.) Many card issuers' policy is not to hold cardholders liable. Card registration is not required for retention of credit or debit cards. To notify AutoVantage of fraudulent use and for information on how to receive reimbursement, call 1-877-259-2696 (9 a.m. — 11 p.m. EST, Mon. — Fri.).

 

Lockout, Towing, and Emergency Roadside Assistance Terms and Conditions

As a member of AutoVantage Gold, you or any member of your immediate family residing in your household will be covered for up to three (3) emergency assistance calls or authorized reimbursements per membership year, up to a maximum of $80 allowance per disablement, for any combination of emergency tow service, emergency roadside assistance and lockout, provided that:

Coverage Includes:
1. You or any member of your immediate family residing in your household is the driver or a passenger in the vehicle at the time of disablement. Immediate family includes spouse, domestic partner, dependent children living at home or away at college, fiancé(e), or parent of member.
2. The disabled vehicle must be a self-propelled, four-wheel vehicle, designed, licensed and used for private on-road transportation, and includes only those trucks with a carrying capacity of up to 2,000 pounds, subject to the exclusions noted below.
3. Lockout service provides access into the vehicle or home. It does not include key extraction or key duplication or lock repair.
4. AutoVantage Gold covers up to three (3) emergency assistance calls per membership year. Only one disablement during any consecutive 7-day period will be allowed. If additional emergency assistance is requested, service will be dispatched, but the member will be fully responsible for all charges incurred, and the charges are not reimbursable.

All 24-Hour Roadside Assistance services are provided by Bricknell Financial Services Motor Club, Inc. dba Road America, administrative offices at 7300 Corporate Center Drive, Suite 601, Miami, FL 33126. For Mississippi and Wisconsin customers, services are provided by Bricknell Financial Services Motor Club. For California customers, services provided by Road America Motor Club, Inc.

Non-Reimbursable Items:
The purpose of the towing and roadside assistance benefit is to provide service in emergency situations.

The following are not considered emergency situations and are therefore not covered for reimbursement:
1. All parts, labor and supplies provided while at an auto repair shop or service station, or towing to a second destination.
2. Service for taxicabs, tractor, boats, commercial vehicles, dune buggies, vehicles used for competition, stolen vehicles, unlicensed/unregistered vehicles, illegally parked or impounded vehicles, or any vehicle in tow.
3. Any and all taxes, fines or ambulance charges.
4. Rental of towing equipment (e.g., trailers or hitches).
5. Towing at the direction of a law enforcement officer relating to traffic obstruction, impoundment, abandonment, illegal parking or other violations of law, or towing by other than a licensed tow provider, service station or garage.
6. Installation or removal of snow tires, repairs to studs, mounting and dismounting of snow chains, or de-icing frozen locks.
7. Repeated service calls for a vehicle in need of routine maintenance or repair.
8. Snow removal from or around vehicle.
9. Vehicle storage charges, cost of parts and installation of products, materials, impounding, and additional labor relating to towing.
10. Members are not permitted to have multiple memberships in AutoVantage Gold and related services/products.

If you do obtain more than one active AutoVantage Gold or related service membership in error, each eligible disablement will only be covered once, subject to the limits described in this Benefits Guide.

Benefits are not available if disablement is due to an act of God (e.g., tornado, flood, hurricane, blizzard), war, fire, insurrection, riot, etc. During other extreme weather conditions, there may be some delay before help can reach you.

If AutoVantage Gold cannot assure timely dispatch of emergency service, you have the option of using your own service provider after receiving a referral number from AutoVantage Gold.

Reimbursement Procedures:
To receive a refund for preauthorized emergency service which you pay for/arrange, please provide the following information for verification records: a legible, original, pre-printed, itemized receipt showing the name, address and telephone number of the commercial garage, service station, locksmith or other licensed repair facility providing the service, detailing the date of disablement and amount charged for emergency towing/wrecker/road service/lockout, and describing in detail the cause of the disablement, along with your name, referral number, address and membership number. All components listed above are required to accept your claim and should be mailed for reimbursement consideration to:
